Around 9:30 this morning, at least four vehicles, including one tractor trailer, were involved in a multi-vehicle crash. The crash occurred on I-30 approaching I-35E.

One driver involved in the crash claimed the tractor trailer hit the rear of her car and then pushed two other vehicles into a guardrail. The tractor trailer allegedly then spilled diesel fuel onto the highway, causing hazardous materials crews to be called to the scene to clean up. As a result of the accident, as well as the presence of the hazmat crews, traffic was backed up for several miles on both I-30 and I-35E.

A newly released national survey conducted by the Ad Council has shown how widespread and dangerous texting while driving is becoming in the United States.

Distracted driving is the number one killer of American teens, according to the National Highway Traffic Safety Administration. Eighty-two percent of drivers between the ages of 16 and 24 have read a text message while driving. Sixteen percent of all drivers younger than age 20 who were involved in fatal crashes were reportedly distracted while driving. A driver who is texting while behind the wheel is 23 times more likely to be involved in a crash than a non-texting driver.

In order to encourage drivers to stop texting and driving, the State Attorneys General and Consumer Protection Agencies, the National Highway Traffic Safety Administration and the Ad Council are joining together to launch a new public service advertising campaign across the U.S. The campaign will include TV, radio, outdoor and digital ads. The campaign will also feature Facebook, Twitter and YouTube content. All advertisements will direct viewers to www.stoptextsstopwrecks.org, a website that will give teens and young adults information about texting and driving and tips on how to avoid it.

The promoters of the ad campaign are hoping it will have the same impact on behavior as prior campaigns which targeted seat belt usage and drunk driving. Texting is now becoming as much of a problem as drunk driving – research has shown that texting can delay a driver’s reactions as much as having a blood alcohol concentration of .08 percent, which is the legal limit.

There is no doubt that texting while driving is quickly becoming a major problem on our roadways. If you have been injured in a car accident with a driver who was texting while driving, contact Dallas automobile accident attorney Kris Barber at 817-329-5095 to learn how to pursue your legal rights.

“Damages” means the monetary value of what is required to compensate you for your losses that were caused by your automobile accident. “Damages” is a very broad term, but generally there are two types of damages, economic and non-economic. Punitive damages are a separate type of damages. Punitive damages are monetary damages which are usually not awarded.

Economic damages are monetary damages that are suffered by the party that was injured in the accident. Economic damages is a broad term, and it can include the loss of income because of the accident (both past and present), damage to property (such as your car), medical expenses (both past and present), the loss of future income because of the car accident, and any other extra monetary expenses suffered as a result of the injury. In addition, economic damages can include a variety of other expenses incurred directly or indirectly as a result of the injury, such as any special vehicles or transportation or any special home helpers required because of your injury.

Non-economic damages are damages that can’t be measured in monetary terms. Some common economic damages include mental anguish caused by the injury, pain and suffering, loss of enjoyment of life, loss of consortium (awarded to a spouse for the loss of companionship), and more.

The damages to which a car accident victim is entitled depends on the facts of the case and they can vary greatly from case to case. Have you been involved in an automobile accident in the Dallas area caused by the negligence of another party? If so, contact Dallas personal injury attorney Kris Barber at 972-231-5800.

Automobile accidents can be very scary, below are a few tip for reference on what to do if ever involved in an auto accident.

If you have been involved in an automobile accident, move safely to the side of the road and steer clear of oncoming traffic, if possible. Turn your hazard lights on, and call 911 to report the accident. Wait a safe distance from the road, if possible, for help to arrive.

It’s important following an accident to get as much information as possible from the other driver(s) involved in the accident and witnesses to the accident. Write down the driver’s address, phone number, license plate number and other vehicle information, and insurance information. You should also get contact information for any witnesses to the accident.

After you’ve gotten contact information, make as many notes about the accident as possible. Write down a detailed description of exactly what happened, including each car involved in the accident, the locations of the vehicles before and after the collision, where the collision occurred, and what caused the collision. If your cell phone has a camera, take pictures from as many angles as possible of the damage to the vehicles involved.

Following the accident, you should file an accident report with your DMV or the police station if police did not come to the scene of the accident. You should also contact your insurance company to report the accident. However, you should refrain from giving too many details about the accident or your injuries until you have consulted with a personal injury lawyer. It is important to know your rights and know what to expect before speaking with either insurance company. If you decide to hire a lawyer, they will make contact with the insurance companies for you and handle all of the negotiations.

If you are in the Dallas area, contact accident attorney Kris Barber from The Barber Law Firm for a free consultation and to learn more about your options following the accident. Call today at 972-231-5800.

If the defendant in your automobile accident case has insurance, prior to any offer of settlement, an insurance adjuster will want to evaluate all documentation regarding the accident and the expenses incurred. Those records could include things like medical records, records of lost wages, out-of-pocket expenses, and other types of medical documentation regarding any permanent injuries that were caused by the automobile accident.

The insurance company may make an initial offer to settle after receiving all required documentation. If after negotiations, the insurance company offers a fair settlement that you are satisfied with, then the case is over. You sign a Release and receive a check from the insurance company. This process generally takes 6 – 8 months from the date of the accident, but can vary depending on the length of medical treatment you receive after your car accident.

However, if the settlement offer is unacceptable and the automobile insurance company won’t budge, you may choose to pursue the case further, such as by filing a lawsuit. Once a lawsuit is filed, it could take a significantly larger amount of time. Due to the busy schedule of most courts, trials usually occur between 1 and 2 years after the lawsuit is filed.

Once the suit is filed, both parties will investigate the claims in a process called discovery. Discovery could include taking depositions from the parties involved, or seeking additional documentation on the details of the car accident. After discovery is completed, both sides may begin settlement negotiations or enter into mediation prior to trial. Most car accident cases settle prior to trial.

Have you been involved in a car accident caused by another driver’s negligence in the Dallas area? If so, you could have a potential case. To learn more, contact Kris Barber, Dallas automobile accident attorney at the Barber Law Firm. He has experience both with case settlement and with trials. Call him today at 817-329-5095.

Newly released statistics show that almost a quarter of all drivers in Dallas County are uninsured. Among Texas’s largest six counties, that is the highest percentage of uninsured drivers in the state. State law requires that drivers maintain minimum levels of coverage. Texas has also maintained a three-year initiative designed to bring down the number of uninsured drivers.

Under Texas law, drivers are required to maintain minimum insurance coverage. The minimum coverage amount is $30,000 for each injured individual ($60,000 per accident), and $25,000 in property damage. Texas has a program, called TexasSure, which allows law enforcement officials and county tax officials to confirm electronically whether a Texas vehicle has insurance coverage. The program is attempting to prevent drivers from using counterfeit insurance cards or canceling insurance coverage later.

If a driver is discovered to be violating the insurance laws, the first conviction can result in a fine of between $175 and $350. Subsequent convictions may result in fines of between $350 and $1,000, a driver’s license suspension, or even vehicle impoundment.

It’s imperative for all drivers to obtain uninsured motorist insurance coverage. This insurance coverage is aimed at protecting you if you are involved in an accident with a vehicle that does not have insurance coverage. Uninsured motorist coverage does not add much to the costs of most insurance policies, and it can be critical in the event of an accident.

Have you been involved in an accident in the Dallas area? If so, contact Dallas automobile accident attorney Kris Barber at the Barber Law Firm today at 817-329-5095.

After a personal injury accident occurs, it can be very confusing to figure out who is responsible for paying your damages. Will any of your personal insurance policies cover the accident? What about the policies of any other parties involved in the accident?

Most automobile, homeowners’, and commercial liability insurance policies contain coverage for medical expenses incurred after an accident without regard to who was at fault for the accident. This coverage in automobile policies typically applies to the insured’s family members and the vehicle’s passengers only, while homeowners’ policies and commercial policies cover only visitors to the premises.

Health insurance, worker’s compensation insurance, or disability insurance carriers usually will pay benefits arising from accidental injuries. However, if you file a personal injury claim against another person or a business and that claim succeeds, then the insurance provider will probably require you to repay these benefits to the company. If the accidental injury is primarily your own fault, then only health insurance (such as through your employer), worker’s compensation, or medical payments coverage may apply. If you are in an accident caused by an uninsured driver, you can be compensated by your own “uninsured motorist” coverage (if you have it) applying the same general rules as insured drivers.

Dealing with your insurance company or companies, as well as any other party’s insurance company after an accident can be frustrating. If you have been involved in an accident in the Dallas area, contact Dallas personal injury attorney Kris Barber at 817-329-5095. He has extensive experience in working with insurance companies and can help protect your rights.

Soft tissue injuries are a very common result of automobile accidents. Soft tissue injuries include damage, such as sprains, strains, tears and soreness to the tendons, muscles and ligaments. Car accidents often cause damage to the body’s soft tissues because of the crash impact and the sudden jolting of the body. That impact can cause soft tissues to stretch, which frequently results in damage. That damage can include pain, limited mobility and swelling.

A big problem with soft tissue injuries is they are hard to diagnose. They can’t be found on an x-ray. It typically takes several hours, or sometimes even days, for a car accident victim to experience symptoms of a soft tissue injury. That means it can take time for victims to get the proper treatment. This also means that often accident victims with soft tissue injuries are viewed skeptically by the opposing parties in an accident case.

Whiplash is a very common type of soft tissue injury. Whiplash occurs when a person is in a vehicle that is hit from the rear, causing the head of the accident victim to jerk forward and back, causing a lot of pressure on the neck. Some symptoms of whiplash include headaches, neck pain, stiffness, and sometimes shoulder and back pain. Whiplash can cause spinal damage, joint problems and constant pain.

Automobile accident victims who suffer soft tissue injuries due to another driver’s negligence can recover money for medical expenses, pain and suffering and more.
