The Dallas/Fort Worth area has become a hub for major sporting events, festivals, and other events and attractions that draw thousands of tourists. Although events such as the World Series bring a lot of tourism money into the DFW area, they also bring a lot of traffic nightmares for many residents.

With this being the second year in a row of the World Series coming to Arlington, the city has made plans to prevent the extreme congestion associated with a major sporting event. In addition to the World Series, the Dallas Cowboys hosted the St. Louis Rams during one game of the World Series. During that time, there were also several other events going on in the area.

Additional parking lots were opened up to handle the traffic, and each had several access points. During days when the Cowboys were not playing, additional parking was available in lots in the Cowboys Stadium. The city of Arlington also set up a special World Series website that contained updated information on traffic and parking. Even with the advance preparation, traffic in the area was still a nightmare for many drivers.

When driving to events with a huge turnout, such as a World Series game, experts recommend leaving early, wearing comfortable shoes, and preparing for a long walk. It’s also a good idea to be aware of your surroundings, especially at night. Also, avoid leaving valuables in your vehicles. Thieves often see huge sporting events as a great opportunity. It’s also important to avoid parking on private property. If you park in a private business’s lot, you risk parking illegally and giving your money to scam artists who don’t own the lot, and you could get towed.

If you are attending a big event in the Dallas / Fort Worth area, be careful and have fun. If you have been involved in an accident in the area due to the negligence of another careless driver, contact Kris Barber, Dallas automobile accident attorney, at 972-231-5800 to pursue your legal options.

Determining fault is very important following a car accident. The party who was at fault typically has to pay for the other party’s medical expenses, damages to his or her vehicle, and other expenses.

Fault is determined by figuring out who was negligent. Sometimes fault is obvious. Both parties involved in the accident will submit their claims to their insurance companies. The insurance companies will determine who they believe is at fault by examining the scene of the accident or photographs, talking to eyewitnesses, and reading the police report. If one of the insurance companies involved believes the driver it covers is at fault, it may offer a settlement to the injured victim. If that settlement is accepted, the case is over.

If the insurance companies do not agree on who is at fault, they may do arbitration or mediation. In those situations, the arbitrator or mediator would determine who was at fault. A last resort is taking the case to trial. At trial, evidence regarding fault would be presented, including testimony from eyewitnesses to the accident, expert witnesses, a police officer at the scene, and perhaps the parties involved in the accident. Following the presentation of the evidence, a judge or jury will determine whether the defendant was negligent or not. If the jury finds the defendant was negligent, it will award appropriate damages to the plaintiff.

If you have been involved in an automobile accident in the Dallas area, you should contact an experienced personal injury attorney. An experienced attorney can help you work through the issues surrounding your injury and can help you get the compensation you deserve.

In Houston last week, a taxi driver was driving two passengers from a medical center when he crashed into a tractor trailer, killing both passengers. He was injured in the wreck. According to eyewitnesses, the taxi driver was speeding and weaving in and out of traffic before leaving the road and crashing into the truck.

Taxi companies, as well as bus operators, train companies, airlines, and other transportation companies, are called common carriers. Common carriers must use a high standard of care for their passengers. In many cases, common carriers can be held liable for the actions of their employees, especially if it can be shown the company was negligent in hiring the driver. In many cases, a driver may have a bad driving record but have been hired anyway.

It can often be hard to tell who is responsible in a taxi cab accident or other common carrier accident. In some situations, taxi drivers own their own cabs, so they are solely responsible for damages in an accident. In other situations, cab drivers rent their cabs from the cab owner, and both the driver and the company can be held liable. In some cases, the taxi companies own the taxis and employ the drivers, which means the companies are liable for the actions of the driver. If the accident was caused by a manufacturer’s defect with the vehicle, or by the actions of another driver, another party could be held liable for the accident.

Taxi accidents can be difficult to litigate. It may be hard to determine which party is responsible, or finding which insurer against which to pursue a claim. If you have been involved in a taxi accident or an accident with another common carrier, contact Dallas accident attorney Kris Barber. He will work hard on your behalf to determine the responsible party and to hold that party accountable for your injuries. Call him today at 817-329-5095 to learn more.

The Texas Department of Transportation recently launched a campaign to remind pickup truck drivers about how important it is to buckle up every time they get into their vehicles. According to TxDOT, using a seat belt reduces the chance of fatalities among pickup drivers by over 50 percent.

Currently, seat belt usage in Texas is at a record high among drivers and passengers in cars. However, pickup truck drivers are not using their seat belts regularly. In Texas, half of all pickup truck drivers killed in traffic crashes were not buckled up. The number of trucks involved in fatal crashes in Texas was about 20 percent greater than the number of cars involved in fatal crashes.

There are two reasons officials believe that pickup truck drivers are less likely to buckle up than drivers of other vehicles. First, pickup drivers often believe they are safer because they are driving a larger vehicle. However, according to TxDOT statistics, pickup trucks are more likely to roll over during crashes and sling passengers out of the windows. Also, pickup truck drivers are less likely to buckle up because more pickup trucks are driven by younger males, a demographic that is in general less likely to buckle up than other groups of drivers.

Although traffic fatalities have decreased between 2003 and 2009, traffic crashes remain the leading cause of death for individuals between the ages of 1 and 44 in Texas. In 2009, over 3,000 people died in fatal accidents in Texas, and just under half were not buckled up. In addition to the safety reasons to buckle up, if you fail to buckle your seat belt, you could receive a ticket for $250 or more.

Have you been involved in a pickup truck accident in Texas? If so, contact Kris Barber, Dallas automobile accident attorney at 817-329-5095.

Recently, several bills in Texas that would have stiffened the punishments for bad behaviors by drivers have failed to become law.

Last week, Governor Rick Perry vetoed a bill that would have banned texting while driving. The bill would have punished anyone found to be texting while driving with up to 30 days in jail and a fine of up to $200. If the driver’s actions resulted in injuries to another person, the driver could have faced six months in jail and a $2,000 fine. Governor Perry did not sign the bill because he believed it represented the attempt by government to micromanage the behavior of adults.

Another series of bills that failed to become law were aimed at DWI offenders. A Texas representative sponsored a bill that would have permanently suspended the driver’s license of anyone convicted of a fifth DWI offense. The representative plans to reintroduce the bill during the 2013 legislative year. Another bill that failed to pass was tougher on drunk drivers – it would have revoked the drivers’ licenses of anyone convicted of a second drunk driving conviction.

However, one bill that may become law that deals with DWIs is the Abdallah Khader Act. The bill would increase the penalties for some drunk drivers. In some DWI cases in which the victim is left in a vegetative state, the maximum penalty would be 20 years in prison instead of 10. In misdemeanor DWI cases where the driver has a blood alcohol content of 0.15 or higher, the maximum penalty would be a year in jail instead of six months. The bill was named after a two year old who was left in a vegetative state after a repeat drunk driver hit his family’s car.

Accidents caused by texting and driving, or drinking while driving, are especially tragic because they could so easily be prevented. If you have been injured in an accident caused by the bad behavior of another driver, contact Kris Barber at the Barber Law Firm. Call him today at 817-329-5095.

Unfortunately, approximately 10 teens die every day in teen-driven vehicles in the U.S. The deadliest time of the year for teen drivers occurs between Memorial Day and Labor Day, because more teenagers are killed in car crashes during this time of the year than any other. This period is sometimes referred to as the “100 Deadliest Days”.

According to information from Allstate Insurance, the two most dangerous roads for teens in Dallas are I-635 and I-35E. On I-635, there were almost 1,500 crashes involving drivers between the ages of 15 and 19 during the four-year period between 2006 and 2010. On I-35E, there were over 1,100 crashes involving teen drivers from 2006 until 2010.

So how do you keep your teen drivers safe on Texas’s roads this summer? First, remember that you are a role model for your teen’s driving behavior. Show your teens safe driving habits and seat belt use. Talk with them about the consequences of using drugs or alcohol while driving, and let them know this behavior is not acceptable. Let your teenager do as much practice driving while you are supervising as possible. Drive in a variety of settings, including heavy traffic, nighttime and daytime, urban and rural settings, and bad weather.

You may wish to set firm rules about certain situations your teen may encounter while driving. You should consider restricting the number of passengers and ages of passengers your teens can have in the car. Having more passengers, particularly other teens, is very distracting for a new driver and can lead to recklessness. You should also limit night driving – most teen crashes occur between 9 pm and midnight. Finally, restrict a teen’s cell phone usage while driving.

If you take certain precautions now, your teen stands a much greater chance of staying safe on the roads. If you are involved in a Dallas car accident with a teen driver, contact the Barber Law Firm at 817-329-5095 today to learn more about your legal rights.

The Texas Department of Transportation recently began a campaign to raise awareness of the dangers of driving while distracted called Talk. Text. Crash. It is intended to encourage Texans not to use their cell phones while they are driving.

According to the National Highway Traffic Safety Administration, deaths caused by distracted drivers are on the rise. The percentage of deaths reported due to driver distraction increased from 10 percent in 2005 to 16 percent in 2009. A large part of the increase can be blamed on cell phones and the increasing practice of texting or emailing while driving.

In Texas, according to the Texas Department of Transportation, about one-quarter of crashes involve driver distraction. In 2009, over 100,000 vehicles were involved in accidents in Texas involving driver distraction. Tragically, 408 of those crashes were fatal.

Although the use of a cell phone, including talking, texting and emailing, is one of the most common causes of distracted driving, there are many other driver distractions that can cause a driver to have an accident. Some of the more common causes of distracted driving are smoking, eating, talking to passengers, or using a GPS device or a radio. In 2009, 3,308 crashes in Texas were attributed to cell phone usage alone. In 41 of those accidents, at least one person was killed.

Have you been injured in a Texas accident that was caused by a distracted driver? If so, you may be able to recover damages for your injuries.

After an accident occurs, insurance companies and attorneys will examine the accident to decide which party was at fault. They will look at police reports, any citations issued, accident photos and witness statements to determine who was liable. Typically, the decision of who was at fault is subjective.

However, in a rear-end collision, usually the driver who rear ended the vehicle is considered to be at fault. State law requires a minimum distance between vehicles, depending on the speed at which they are travelling. This is to allow enough time for the vehicles to be able to stop safely. If one car rear-ends another, it can be assumed that that driver did not maintain a safe following distance.

There are some cases in which a driver who rear-ends another may not be held liable. If the driver who was rear-ended did not have brake or tail lights, the driver who hit the vehicle may not be held liable. If your car was pushed into the rear of another car, you should not be held liable for that accident.

Rear-end collisions are one of the most common types of automobile accidents. In general, more drivers are driving while distracted, which can cause them to fail to see a stopped car in front of their vehicle. In some high traffic areas, rear-end collisions can be hard to avoid because of the sheer volume of cars on the road and the close proximity between the vehicles.

Have you been involved in a rear end collision? Contact Dallas automobile accident attorney Kris Barber at 972-231-5800. He will help you determine what damages you may be entitled to.

If you have been in a car accident that was caused by a negligent driver, your medical records can be important if you decide to later pursue a case against the negligent driver or insurance company. Your medical records may include things that you tell the doctor or nurse.

If you visit a doctor because of injuries from an automobile accident, describe the accident in detail to the doctor. Explain where any impact to your vehicle occurred and what happened to your body as the other vehicle impacted your vehicle. You should also thoroughly describe your symptoms and physical condition since the accident.

Once the doctor determines a course of treatment, follow the doctor’s orders. If you do not feel comfortable with any treatment prescribed, such as medication or surgery, get a second opinion. If you do not follow your doctor’s recommended treatment plan or do not seek medical attention right away, it may be denied later by the insurance company. After you’ve decided on a treatment, complete the entire course of treatment. Discuss any future problems that may remain as a result of the accident, and get detailed information on the extent of your future disabilities.

Have you been injured in a Dallas car accident? Are you unsure of what steps to take in receiving treatment for your injuries? Contact Dallas car accident attorney Kris Barber. After the healing process has begun, you are likely to consider taking legal action against the driver who caused the accident. However, choosing an automobile accident attorney can be overwhelming. Here are some steps you can take to make the process easier.

First, you should consider hiring someone who specializes in personal injury and automobile accidents. Some personal injury attorneys take some types of personal injury cases but not others, so keep that in mind while you are looking for an attorney. If you already have an attorney who has done work for you in the past, ask him or her for a recommendation. Also ask family and friends for recommendations. Contact the State Bar of Texas to ask for recommendations for automobile accident attorneys. Search online for attorneys who seem knowledgeable about car accidents.

Once you’ve compiled a list, narrow down the list to your top choices and call the attorneys. Do they provide free consultations? Do they promptly return your calls? Has the attorney ever handled a case like yours before? How much are fees and how are they paid? Does the attorney seem like he or she is concerned about your accident case? Does the attorney seem knowledgeable about automobile accidents? Do you feel comfortable with the attorney’s personality? Since you and the attorney you choose could be working very closely together, it’s important to choose someone you feel comfortable with.
