<p>Estate planning is the process of managing assets and properties in order to facilitate the smooth transfer of an individual’s estate in anticipation of death. It does not only take into account the persons estate but also considers the effect of such actions on the person’s family in particular. Estate planning takes into account every eventuality and emergency such as those when the person becomes incapacitated or physically impaired.</p>
<p>Estate Planning uses Wills, designation of beneficiaries, appointment powers, and trusts as a tool for securing the maximum amount of benefits for their families. Recently, clients have also been asked to undertake Living Wills as a way for insuring that all agreed plans are followed even when the person becomes incapacitated. </p>
<p>Special agreements could also be arranged under Estate Planning. Arrangements such as being cremated or burial options are also becoming popular. It also covers agreements on when business and assets should be withdrawn.</p>
<p>An estate covers all personal property (jewelry, clothes, personal belonging), bank accounts, any type of investment, and homes owned by person before distribution in their Trusts or Will. All real estate property and all properties such as cars including furniture owned by the client prior to death are included in the items to be distributed to their heirs.</p>
<p>There are many factors that should be considered in the development of an effective estate plan. This includes the computation of the person’s total assets, their market value and the assigning of beneficiaries of the estate. It also considers the development of a timeframe for the distribution of assets, assigning of qualified guardians in cases when they are left before reaching legal age. It also involves the establishment of conditions regarding healthcare and scope of medical care in instances when they become incapacitated.</p>
<p>During estate planning, individuals may also assign the executor or trustee of their Will. It is a decision that is best done by the author of the Will. The size of a person’s estate is not important; estate planning provides individuals a tool for future planning and insures that your family receives your assets in case of death.</p>

<p><strong>Steps in a Civil Lawsuit<br />

<li>Complaint and Summons – A lawsuit begins by filing of a complaint by the plaintiff which details the facts of the situations and the reasons why a complaint is filed. A summon is also issued to the opposing party which provides notice of the lawsuit with a copy of the complaint<br />
Defendant’s Answer &#8211; The defendant has to respond with his or her defenses in writing to the complaint. If the defendant does not file an answer, the court can enter a default judgment against the defendant.</li>
<li>Counterclaim &#8211; If the defendant has his or her own claim against the plaintiff, the defendant would file a pleading and can include this in his answer.</li>
<li>Discovery –This is the process of gathering information and learning what evidence each party has regarding the dispute. Interrogatories or written questions, give sworn testimony under oath and other methods that are relevant to the case.</li>
<li>Pre-trial hearing &#8211; The lawyers or the parties themselves, will meet with the judge for the purpose of simplifying the factual and legal issues prior to trial. The judge can assist the parties in reaching a mutual agreement. If all negotiations fail, the next step is a formal trial.</li>
<li>Jury Trial or Bench Trial &#8211; A trial conducted by a judge without a jury is called a bench trial. Both parties present their evidence and call witnesses to testify. After which, the jury will hold secret deliberations to reach a verdict. In a bench trial, the judge considers all the evidence and reaches a decision.</li>
<li>Judgment &#8211; the judge reaches a judgment and states what relief, if any, the plaintiff is given.</li>
<li>Motions and Appeals &#8211; The losing party can ask for a new trial and make other motions.</li>
</ul>

Automobile accidents are one of the leading causes of traumatic brain injury, which occurs when an outside force impacts the head enough to cause damage to the brain. Although advances in safety measures, such as seatbelts and airbags, coupled with stricter vehicle safety laws, have decreased the amount of traffic-related instances of TBI, traumatic brain injuries are still recognized as one of the leading causes of death and disability worldwide.</p>
<p><strong>Types of TBI</strong></p>
<p>Since the brain is so integrated into the regulation of the body, injuries to this particular organ can be devastating and may result in lifetime disability or coma. In the United States alone, it is estimated that two million people will be hospitalized for a TBI each year. Of these two million people, survival rates and recovery will vary greatly depending on the severity of the individual’s injury, often attributed to the cause and part of the brain damaged. TBI manifests focally (affecting one area of the brain) if the head is struck directly by an outside force or diffusely (spreading to different parts of the brain) if it involves a noncontact injury of the brain moving within the skull. In the former, impact to the skull causes shock waves to spread through the brain, producing tissue damage. Ricocheting of the brain within the skull may result in a contrecoup injury (as opposed to a coup injury), in which damage occurs opposite the side of the head that was hit.</p>
<p><strong>Prognosis of TBI Victims</strong></p>
<p>Death from traumatic brain injury is not always instantaneous, and it is estimated that 40% of TBI patients will suffer from worsening conditions during hospitalization. It has been determined that this is not due to the primary damage dealt at the moment of trauma, but rather results from a secondary injury, or aftereffects triggered by the initial impact , such as brain swelling, fluctuations in blood flow to the brain, or damage to the blood-brain barrier.</p>
<p>Even if a TBI patient makes it to recovery, they are at risk for a number of complications physical and mental, emotional and behavioral. The most devastating of these is altered states of consciousness, such as coma or brain death, but also movement diseases like Parkinson’s, or post-traumatic seizures and epilepsy. Meanwhile, cognitive impairments like memory loss, and behavioral changes such as increased aggression, are often just as de-habilitating to individual’s family as they are the individual themselves, as oftentimes the victim of TBI can emerge with an altered personality.    </p>

<p>Financial and material losses are reimbursed through special damages. These damages involve losses that have known monetary values. But while it may seem like a mere matter of calculation, economic damages are governed by complex laws and there is often a cap on how much one can claim in economic damages. In the case of lost ability to earn, calculations usually involve the person’s life expectancy, current or possible career, and job potential.</p>
<p><strong>Pain and suffering</strong></p>
<p>Problems often arise when it comes to pain, suffering, and other abstract losses. These losses fall under general damages, which refer to non-material effects of the injury. In these cases, the judge bases the amount on the evidence presented and sometimes expert witness testimonies. Because the loss is quite subjective, most states impose caps on the dollar amount that can be awarded in general damages.</p>

<p>Punitive damages are awarded when the breach of duty is proven to be intentional or recklessly negligent, in which case general and special damages are considered inadequate to compensate the victim. These damages are fairly rare and are only awarded in special cases. Unlike compensatory damages, there is usually no cap on the amount of punitive damages, although they seldom exceed 4 times the amount compensatory damages ordered.</p>

<li>Working on your coordination and balance can be as easy as walking regularly for exercise. There are also balance exercises that you can do, as well.</li>
<li>Addressing any mental health issues, that relate to stress factors, will keep your muscles from      becoming tense, which can lead to strain and injury. Also, increased stress will lower your threshold for pain. You can adopt coping mechanisms in order to deal with stress – both at work and at home. These can include deep-breathing exercises, walking around the block or confiding in a close friend or family member.</li>

<p>Motorcyclists know how to protect themselves by:<br />
•	Wearing helmets – this is a requirement by law in nearly all states and countries<br />
•	Wear protective clothing – the leathers look great but they also protect the skin in case of accidents as well as weather conditions. Boots are there for protection against the weather and accidents too. Those chains can save a bikers life in the event of a fall.<br />
•	Being visible – in some countries it is a law requirement to have lights on at all times for a motorbike.<br />
•	Usually keep their vehicles in tip top condition. Any kind of failure on a bike can end in fatality and bikers know this. They also generally love their bikes.</p>
<p>Not being visible is what causes a huge number of accidents. Cars are often not looking for bikes as they turn corners or approach roundabouts. That coupled with the speed at which motorbikes can travel can lead to accidents. Many car drivers often state that they could not have been responsible as they ‘didn’t see the rider coming’. This does not by any means imply that the cyclist is in the wrong. Motorcyclists are obliged to follow the road rules just as anyone else is (with a few added extras) and if they were doing so at the time of an accident they are in the right and entitled to sue for personal injury damages. </p>
<p>Poor weather conditions make motorcyclists even more vulnerable from both the surface road conditions and the visibility aspect. </p>

			<content:encoded><![CDATA[<p><strong>How is traumatic train injury defined?</strong><br />
Traumatic brain injury (or TBI) is defined as an area of the brain that has suffered damage through an impact trauma. This can occur when blunt force is applied to the head – for example, during an automobile accident. There may also be instances when a foreign object can pierce the skull and enter the brain.</p>
<p>The resulting symptoms can range from mild to extremely severe, depending on the location of the brain damaged and the amount of damage that has occurred. An individual who has suffered a mild form of TBI may or may not lose consciousness but have effects that manifest at a later date. These symptoms can be in the form of confusion, dizziness, headaches, blurred vision, altered sleep patterns, mood swings, loss of memory, ringing sounds in the ears or an unusual taste in the mouth.</p>
<p>More moderate to severe symptoms will be the same as the mild manifestations but with headaches that occur chronically (with increasing severity) and may result in nausea/vomiting, seizures, speech difficulties, numbness in the arms or legs, increased levels of agitations and confusion.</p>
<p><strong>Is there treatment available?</strong><br />
Those individuals who show signs of moderate to severe TBI, following a head trauma, need to seek immediate medical attention. The reason for this is that, even though the initial damage cannot be repaired, the person must be stabilized in order to prevent further injury. </p>
<p>This stabilization can be accomplished by monitoring (and possibly increasing) the oxygen supply to the body (particularly the brain) along with a battery of tests to determine the actual extent of the damage. Imaging tests along with X-Rays of the head and neck area will reveal any fractures that were incurred during the trauma or any spinal irregularities. The imaging tests will be in the form of a computed tomography scan (CT scan).</p>
<p>For those who have received a moderate to severe brain injury, surgery will usually be indicated to remove/repair blood clots (hematomas) in about 50% of the cases. Depending on the injury, physical therapy, speech therapy, psychological treatment and other therapies may be needed along with social issues assistance. In more serious cases, the results of the injury may include coma or a persistent vegetative state, in which the person is unconscious and unaware of their surroundings and need around-the-clock medical care.</p>

			<content:encoded><![CDATA[<p>A <strong>Protective Trust</strong> (in the United States – but different in the UK) is a trust that is generally used as a tool in estate planning. This can also be considered as an asset protection trust. This type of trust may be created when the settlor is concerned that the beneficiary would not receive any of the trust’s assets, due to claims by creditors before the settlor’s death. In this case the trust is constructed to allow both the settlor and the beneficiary to use the assets of the trust with the remainder going to the beneficiary at the time of the settlor’s death. The trust assets are then safe ,as long as the trust was set up before the settlor’s debts were incurred. </p>
<p> <strong>Purpose Trusts</strong> (in this case – non-charitable purpose trusts) are usually not permitted &#8211; with the exception of certain offshore jurisdictions. All charitable trusts are considered purpose trusts.</p>
<p>A <strong>Resulting Trust</strong> is actually a form of an implied trust. This can result from the original trust failing (either whole or in part) and the settlor, once again, becomes entitled to the assets. Another scenario could involve a payment of the assets being made, which cannot be considered as a gift. </p>
<p>A <strong>Revocable Trust</strong> can be amended or revoked at any time by the settlor (unless mental illness is proven). This type of trust is increasing in popularity and is used as a substitute for a will. This will decrease costs that can occur with probate and serves to centralize the administration of the settlor’s assets upon death.</p>
<p>A <strong>Secret Trust </strong>is also known as a post mortem trust and is a function of a will which imposes certain obligations with the will operating as a trustee.</p>
<p>A <strong>Simple Trust</strong> is one in which the trustee distributes the assets to the beneficiary, according to the specific terms of the trust. In Federal income tax law, a simple trust is one in which the net income must be distributed on a yearly basis.</p>
<p>A <strong>Special Trust</strong> exists in contrast with a Simple Trust – see above.</p>
<p>A <strong>Spendthrift Trust</strong> will allow the trustee to determine the amount distributed to the beneficiary in order to control excessive spending.</p>
<p>A <strong>Testamentary Trust</strong> (Will Trust) is created within a settlor’s will and becomes effective upon death. This trust is usually created at the time of death or thereafter.</p>
<p>A <strong>Unit Trust</strong> is one where each beneficiary holds a certain number of trust units that amount to a percentage of that trust. The beneficiaries can then direct the trustee to pay them out of the trust according to the amount of units that they possess.</p>
<p>This list should be considered as a starting point for understanding trust designations. However, new trust types are continually being designed to meet the needs of potential settlors.</p>

			<content:encoded><![CDATA[<p>When someone is doing the same activity over and over they may end up suffering from Repetitive Stress Injuries or RSI. The reason for this is due to repetitiveness over long periods of time causing damage to nerves, tendons, and muscles.  Examples are having sore hands from typing on a keyboard all day or sore legs and back from riding a bicycle for long distances.  Much like Fibromyalgia, there is a debate as to whether or not RSI is a medical condition. However, it is used as a broad definition in order to explain injuries with these kinds of signs and symptoms.</p>
<p><strong>Who Gets RSI?</strong></p>
<p>It is more likely for those who do the same thing over and over to get RSI. The most common types of workers who get RSI are people who type for long periods, truck drivers, factory workers, and traveling salesmen because of the type of work they perform.  A widely known term that has been associated with RSI is Carpal Tunnel which affects the wrist and joints of the fingers.</p>
<p><strong>Causes And Symptoms Of RSI</strong></p>
<p>The usual suspects for causing RSI are not resting enough and poor posture. If a person does not take enough preventative measures they may be at risk for RSI as well. So how do you know if you have RSI? If you have had symptoms such as:</p>
<ul>
<li>Recurring pain in a particular area of the body such as the shoulders, neck, wrists, fingers, or back.</li>
<li>Numbness or tingling of the skin in the areas with pain.</li>
<li>Muscles in the affected area that feel stiff, generally in the morning.</li>
<li>Along with pain in the wrist or arms, there may be inability to grip well and loss of strength.</li>
<li>Symptoms ease or stop all together after not performing those tasks for a few days.</li>
</ul>
<p><strong>Treatment Of RSI?</strong></p>
<p>In order to treat RSI you will need to see a physician who can find the muscles and tendons that are affected. The general treatment involves adequate rest. The doctor will usually suggest a change in lifestyle and habits as well, given the fact that they are what have caused the injury. When the doctor establishes the correct area that is injured, they will be able to establish what is causing the injury.</p>
<p>In most cases it is the work environment that is causing these injuries and interfering with your ability to heal. The good news is in these cases it is possible to file for compensation from your employer. Even though there is a debate as to whether this is a true medical condition, the courts still see it as a valid claim given the fact that you have suffered due to your job. RSI claims are very similar to other types of work injury claims.</p>

			<content:encoded><![CDATA[<p>In 2006 the Tax Care Relief and Health Care Act of 2006 created the IRS Whistleblower Program. This program was created in order to handle reports submitted by individuals who reveal tax abnormalities in the workplace or personal life.  These individuals who came forward would be gifted with 15%-30% of the profits that the IRS acquires, only if they choose to move forward with the information the informant has supplied.</p>
<p>According to the law, the informant will be rewarded when the sum the whistleblower has provided, which includes interest, taxes, and penalties, adds up to over two million dollars. Another requirement for the informant to be eligible for this program is that the taxpayer that has been reported has a minimum of two hundred thousand dollars in gross income.  However, if the amount of collection is less than two million dollars, the informant may still be presented with 15% of the money collected.</p>
<p><strong>IRS Whistleblower Program</strong></p>
<p>While the Whistleblower Program may seem new, there has actually been a previous version known as the IRS Rewards Program.  However, this past program offered incentives of usually 10% of the taxes recovered to any individual who offered evidence of a individual or business not paying the full amount they owe in taxes.</p>
<p>The sole purpose of this program being created was to aid the IRS in its efforts to investigate and reveal any taxpayer that was not paying the actual amount of taxes they owed.  The program is geared to offer rewards to those who voluntarily step forward and identify a taxpayer of any type who were deceiving the government by paying less than what they truly owed.  These underpayments are usually a product of mistakes or fraud.</p>
<p>Essentially the IRS has used this program as motivation for others to come forth and help stop the underpayment of taxes to the IRS.  The biggest benefit of this program is that there is no limit to the sum of the reward which can be up to 30% of monetary collections.</p>
<p><strong>Receive a Reward Under the Whistleblower Program</strong></p>
<p>The IRS encourages anyone with information to step forward; however, they need solid evidence that there has been a violation of the tax laws.  It is frowned upon when an individual offers “flimsy” or uncorroborated information that is based on a hunch or dispute between the individual and the informant.</p>
<p>If a whistleblower does not meet the requirement of the collection resulting in more than two million dollars, or the individual they are reporting has less than two hundred thousand dollars in gross income, the IRS offers a different reward program.  The individual is also allowed to appeal the sum they were rewarded by filing a claim with the  U.S. Tax Court.</p>
